Terms & Conditions

These Terms & Conditions ("Terms") apply to estimates, proposals, and asphalt paving and related services provided by Around Town Paving ("Contractor," "we," "us," or "our") to our customers ("you" or "Customer") in and around Concord, NC and the Greater Charlotte region. The specific price, scope of work, schedule, deposit, and workmanship coverage for your project are set out in your written estimate and signed contract, which control if anything in them differs from this page.

This page is provided for general information. Your signed written contract is the controlling document for your project.

Part I — Paving Services Terms

1. Estimates & Written Contract

Every estimate is subject to an on-site inspection and final written approval by Around Town Paving. Work is scheduled after a written contract, and any required deposit, has been signed and received. Pricing in an estimate may be revised if the scope, measurements, or site conditions differ from what was assumed when the estimate was prepared.

2. Payment Schedule & Late Payments

Payment amounts and due dates are stated in your written estimate or contract. Unless your contract states otherwise, a deposit may be required before the project is scheduled, with the remaining balance due upon substantial completion. Past-due balances may be subject to a late charge and finance charge at the maximum rate permitted under North Carolina law. Around Town Paving may pause scheduled or in-progress work on a project while a balance is overdue.

3. Change Orders

Any change to the agreed scope, materials, or price must be approved in writing — including by email or text message — by both you and Around Town Paving before the additional work proceeds. Verbal requests are not binding until confirmed in writing. Additional services such as extra excavation, grading, drainage corrections, or base repairs may be billed separately through a written change order.

4. Scheduling & Delays

Start and completion dates are estimates. They may be affected by weather, temperature and curing conditions, material and equipment availability, crew scheduling, utility locating, permitting, and hidden or unforeseen site conditions. We will make reasonable efforts to keep you informed of changes. A delay caused by these factors is not a breach of the agreement.

5. Site Access & Preparation

You agree to provide reasonable, clear access to the work area before the scheduled start. Vehicles, equipment, and personal property should be moved out of the work area. Around Town Paving may reschedule if safe access is not available.

6. Marking of Private Underground Systems

Before work begins, the property owner is responsible for locating and clearly marking private underground systems that public utility locators do not cover, including:

  • irrigation and sprinkler lines;
  • invisible or underground pet fencing;
  • septic tanks, lines, and drain fields;
  • privately owned water, gas, or electrical lines;
  • low-voltage and landscape lighting; and
  • private drainage and similar concealed components.

Where required, Around Town Paving will request public utility locates through North Carolina 811. Public locates do not mark privately owned lines, so the property owner must have those marked separately.

7. Concealed & Unforeseen Conditions

Around Town Paving is not responsible for damage to underground systems or other concealed conditions that were not marked or disclosed before work began, or that could not reasonably have been identified. If unforeseen conditions — such as an unstable sub-base, buried debris, or drainage problems — are found, additional work may be needed and will be handled through a written change order.

8. Limited Workmanship Warranty & Exclusions

Around Town Paving provides a limited workmanship warranty covering defects in workmanship for the period stated in your written contract, measured from the date of substantial completion. This limited warranty does not cover, among other things:

  • normal wear, surface fading, and minor hairline cracking, which are ordinary characteristics of flexible asphalt pavement;
  • cracking, settling, heaving, or depressions caused by soil movement, moisture, tree roots, or the condition of the existing sub-base;
  • damage from vehicles or loads heavier than ordinary passenger use, sharp turning, or concentrated point loads;
  • water or drainage conditions outside the agreed scope of work;
  • damage from third parties, chemicals, fuel or oil, or events outside our reasonable control;
  • areas the Customer asked us to pave over an existing surface or an inadequate base after we advised otherwise; and
  • edges and transitions where new asphalt meets an existing surface.

Warranty service is suspended while a balance remains unpaid. To request warranty service, contact us in writing within the stated period. To the extent permitted by law, this limited warranty is provided in place of other express warranties; nothing in these Terms removes rights that cannot be waived under North Carolina law.

9. Governing Law & Venue

These Terms and your contract are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. The parties agree that the exclusive venue for any dispute is the state or federal courts located in North Carolina, in the county where the project is located or where Around Town Paving maintains its principal place of business.

10. Attorney's Fees & Collection Costs

If Around Town Paving must take action to collect a past-due balance or to enforce these Terms or your contract, you agree to pay reasonable attorney's fees, court costs, and collection costs to the extent permitted by North Carolina law.

11. Force Majeure

Around Town Paving is not liable for a delay in or failure of performance caused by events beyond our reasonable control, including severe weather, natural disasters, fire, labor disputes, material or fuel shortages, utility or permitting delays, accidents, and government actions.

12. Entire Agreement

Your signed written estimate or contract, together with these Terms, forms the entire agreement between you and Around Town Paving for the project and supersedes any prior discussion, proposal, or representation, whether verbal or written. If a provision is found unenforceable, the remaining provisions stay in effect. A written contract signed by both parties controls if it differs from this page.

Part II — $500 Off Promotional Offer Terms

The following terms apply to our $500 off promotional offer. The offer is valid on qualifying new asphalt paving projects booked in July 2026 and ends at 11:59 PM ET on July 31, 2026.

  • Valid on new residential and commercial asphalt paving projects with a minimum contract value of $3,500 before taxes and applicable fees.
  • Website code JULY500OFF must be mentioned when requesting your free estimate and before accepting your written estimate.
  • A signed contract and any required deposit must be received by 11:59 PM ET on July 31, 2026 to qualify for this promotion.
  • One promotional discount per customer, property, or project.
  • The discount applies only to qualifying paving services performed by Around Town Paving and has no cash value.
  • The offer cannot be combined with other coupons, discounts, financing promotions, special pricing, insurance claims, or previously accepted estimates.
  • The offer applies only to new contracts and cannot be applied to completed projects, existing contracts, prior estimates, or work already scheduled.
  • Additional work, change orders, unforeseen site conditions, grading, drainage corrections, excavation, base repairs, or other services not included in the original contract may be billed separately and are not automatically eligible for promotional pricing.
  • Every estimate is subject to a site inspection and final written approval by Around Town Paving.
  • Project scheduling is subject to weather, material availability, equipment availability, crew scheduling, and other circumstances beyond the company's control.
  • The customer is responsible for providing reasonable access to the work area before scheduled work begins.
  • Around Town Paving reserves the right to decline projects that are unsafe, outside its regular service area, or otherwise unsuitable for construction.
  • The offer is valid only within Around Town Paving's regular service area.
  • The discount may not be transferred, assigned, substituted, exchanged, or redeemed for cash or credit.
  • Around Town Paving may modify, suspend, or discontinue this promotion at any time without prior notice; qualifying contracts signed during the promotional period will continue to honor the promotional discount.
  • By accepting this offer, the customer agrees to these promotional terms.
